General conditions

This agreement regulates the conditions of the reservation service in the accommodation of the company “Puesta de Sol Rentals Tenerife”, commercial name, and company name Proyectos y Servicios Herygon S.L., with NIF B38890729 and fiscal address at Calle Isla de Fuerteventura 15A, C.P. 38687, Playa de San Juan, Santa Cruz de Tenerife.

“The Client” at the time he completes the registration process, and makes a reservation, expressly accepts and submits to the clauses specified below, as well as the conditions of access and use of our portal and its privacy policy.

“The Client” acknowledges having sufficient legal capacity to be contractually bound.

This contract is permanently accessible in the General Contracting Conditions of our website.



1. PRICES


In consideration for the reserved stay, “The Client” expressly agrees to pay “Puesta de Sol Rentals Tenerife” the price specified at the time of booking on the website for the accommodation, days of stay and chosen services.

Once the selection of accommodation, days of stay and services has been completed, and prior to confirming the reservation, the final price of the reservation will appear on the screen, which will include the IGIC (Canary Islands General Indirect Tax).

The amount relating to the rental agreement will be shown in Euros. Any price shown in a currency other than the Euro will be for informational purposes only and should not be considered accurate or updated in real time, as exchange rates may vary.


2. RESERVATION PROCEDURE


Orders may only be placed through this website by individuals of legal age and companies.

The different accommodations are detailed on the website individually. The procedure to make and manage the reservation is indicated on the website and only the following steps must be followed:

*Choose the accommodation, indicate the days of stay and the number of people who will spend the night.

*Select, if you wish, the additional services offered.

*If you have a discount coupon, you can enter it in the section: Do you have a promotional code? Click on that link and a box will open to enter the coupon. Remember to click on apply for the discount to become effective.

*To process the reservation, you must complete a registration form with your personal data to formalize the process, for which you must read and accept our privacy policy.

*Once the process has been processed, you must check the acceptance box and read the general contracting conditions. Therefore, we ask you to take a few minutes to read this document. We will be at your disposal to provide any clarification you may need regarding this document.

*You must confirm the reservation by pressing the “Book” button.

*At this time you will be redirected to the electronic payment gateway of the BBVA entity, to make the payment you must use a credit/debit card. This website has SSL (Secure Sockets Layers) and 3Dsecure encryption, where you can enter your card details confidentially and securely. For the operation to be effective, the card must be valid, in addition to being authorized for Internet purchases, because the payment is secure, it is possible that you receive an SMS on the phone that is linked to your card, you must enter that code when requested by the system, so you must also have your mobile phone on hand.


2.1.- Special requests


If you wish to make a special request, you must do so before completing the booking confirmation pages or within a reasonable period of time thereafter. We will attempt to pass any reasonable requests to the relevant Hosting Administrator, but we cannot guarantee that requests will be met. The fact that a special request has been noted in your confirmation email or other documentation, or has been transmitted to the Accommodation Manager is not confirmation that the request will be fulfilled. Failure to comply with any special request will not be a breach of contract on our part unless the request has been specifically confirmed. Please note that we accept no liability for any items/arrangements not confirmed in writing by us.


3. PAYMENT AND CONTRACTING CONDITIONS


“The Client” may make their reservation through the “Puesta de Sol Rentals Tenerife” website. By making the reservation, the client accepts and undertakes to pay in full and in advance for the reservation of the chosen accommodation. To do this, we offer you, without any additional cost, to make the payment in the following way:

Payment at the time of booking. 100% of the total amount is paid by credit/debit card.

Free of charge and without any additional cost, the reservation can be canceled up to 15 days before entering the accommodation and 100% of the reservation will be paid to the client. After this period, that is, 15 days before entering the accommodation, the client will be charged 100% of the reservation.

The refund is made by the same means that the payment was made.

All payments, as clarified in point 2, are made by debit/credit card, through BBVA's secure payment gateway.

This formula will also be applicable for the payment of the security deposit (bond), of which we provide further information in point 4 of this document.

Only in the event that the reservation is made by telephone, by email, or through our network of agents or collaborators, “Puesta de Sol Rentals Tenerife” reserves the right to cancel the reservation in the event that it is not has made in the aforementioned reservation confirmation payment of 100% of the total rental amount, for this you have a maximum period of 24H.

In the event that the reservation is made at least 30 days in advance of the rental start date, “The Client” must pay the total rental amount in advance at the time of reservation.


4. DEPOSIT OR SECURITY DEPOSIT


As a deposit, "Puesta de Sol Rentals Tenerife" will keep the credit or debit card number as a guarantee to cover any possible damage or damage that may be caused to the holiday home due to misuse of the establishment or failure to do so. comply with the standards established by the company.

These damages or defects will be those referred to the holiday home and/or the common areas of the community of neighbors to which it belongs. In addition, damages or defects caused to the holiday home will be considered those related to the home and its furniture and belongings or loss of keys or remote controls.

If this happens, in the days after leaving the establishment, you will be charged an amount never greater than the price paid for the rental.

If the amount of the reservation does not cover the damage or damage caused, the client agrees to pay the difference between the cost of the repair/replacement and the amount of the reservation.

This collection will be made by the same means by which the payment was made.


5.- FOLLOW UP YOUR RESERVATION


In order for you to be informed at all times of the management of your reservation, you will receive a confirmation notice by email at the address you indicated in the form.

6. ENTRANCES AND EXITS OF THE CUSTOMER TO THE LEASED HOUSING


Entry into the rented home must be made from 3:00 p.m. on the day the rental begins and until 8:00 p.m. on the same day, and can be requested either at the time of booking, or by email to Proyectosyserviciosherygon@hotmail. .com 48 hours in advance to enter the accommodation (this service carries a supplement) up to a maximum of 11 pm on the day of entry, and you must leave the accommodation before 12 pm on the last day of the end of the contract. In this regard, “Puesta de Sol Rentals Tenerife” will duly inform “The Client” about the delivery and collection of the keys to the home. With prior written confirmation from “Puesta de Sol Rentals Tenerife”, “The Client” can request a delay in departure, and in this case must pay an amount depending on the number of hours for late check-out, however it is a service subject to availability.

In any case, the client will be accompanied by a person responsible for the company or delegated and authorized by it, when handing over the keys, at the entrance to the holiday home and at check-out.

To hand over the keys, the client will send a Whatsapp message informing them of their arrival time at Posita de Sol Rentals Tenerife by calling +34 690685345 with a minimum of 48 hours' notice or via email to the address Proyectosyserviciosherygon@hotmail. com. A person responsible for the company or a person delegated and authorized by it, will be waiting for you to hand over the keys, accompany you to the home, show you the conditions in which it is located and the basic uses of the facilities. This key delivery procedure does not exclude any other procedure that is agreed upon by the parties or that the company decides to do automatically for the client, via key boxes with security code, automatic and intelligent locks, etc. In any case, the client will always receive instructions through the aforementioned means.

To check out, the client will go to “Puesta de Sol Rentals Tenerife” through the aforementioned routes and inform them of the departure time on the day the contract ends. In the same way as at check-in, a person responsible for the company or delegated and authorized by it will come to receive the keys and check the condition of the holiday home, which must be in similar condition and cleanliness to those he found it.

In the event that "The Client", for reasons beyond the control of "Puesta de Sol Rentals Tenerife" could not occupy the property on any of the agreed rental days (late arrival or early departure), the latter will not make any refund to the former. .

If "The Client" wishes to extend the stay, they must request it at their reservation office as soon as possible, and it will be confirmed or denied depending on the accommodation provisions of “Puesta de Sol Rentals Tenerife”.


7. CANCELLATION POLICY


“The Client” must be aware that the cancellation policy is always strict. This means that, although the client can cancel their reservation at any time, payments made will not be refundable. Next, we clarify this point.

“The client” may cancel the reservation prior to the start date of the rental, with the following penalties:

From the confirmation date until 15 days before the start of the lease, 0% of the total amount. The refund is made by the same means that the payment was made.

From the 15th day prior to the start date of the lease, 100% of the total amount.

If it is a NON-REFUNDABLE rate, due to offers or promotions with added discounts. The penalty will be 100% from the moment of reservation.

In case of "no show" (if you do not show up) “Puesta de Sol Rentals Tenerife” will charge the entire reservation as a penalty cost.

If you are going to arrive late or late on the day of check-in or if you arrive the next day, be sure to inform “Puesta de Sol Rentals Tenerife” (promptly and in due time) so that we know when you will arrive and thus avoid let's cancel your reservation.

To confirm the cancellation, the client must state in writing, by sending an email to Proyectosyserviciosherygon@hotmail.com requesting the cancellation. Only requests received from the same email with which the reservation was made will be considered valid.

The cancellation will be considered made from the moment in which “Puesta de Sol Rentals Tenerife” or its agent has received it in writing.


8. OBLIGATIONS OF "THE CUSTOMER"


The number of people with access to the rented home will be those stated in the contract or confirmation of the reservation, including children or babies, and access to the property may be prevented by the property or “Puesta de Sol Rentals Tenerife”. the same if the agreed number is exceeded.

At the end of the lease, "The Client" is obliged to leave the home in the same state of order and cleanliness in which he received it when he entered (as a guide: clean dishes placed on the corresponding shelves, refrigerator without food remains , garbage deposited in the corresponding containers, etc.), all this even if the cleaning was included in the rental price or a final cleaning had been contracted. “Puesta de Sol Rentals Tenerife” reserves the right, in the event of non-compliance with the above, to deduct from the deposit the amount necessary for extraordinary cleaning expenses.

"The Client" is obliged to respect the rules of coexistence with the rest of the neighbors of the property where the home is located, as well as the rules of the Community of owners. In the event that these rules are not respected or inappropriate behavior occurs, both the property and “Puesta de Sol Rentals Tenerife” reserve the right to cancel the rental contract with immediate effect and without prior notice, without any obligation to refund. of the amount paid for the lease.



9. CLAIMS


Although “Puesta de Sol Rentals Tenerife” rigorously controls the condition of the homes, if there is any damage to the accommodation, "The Client" must notify it immediately Telephone +34 690685345 or E-Mail: Proyectosyserviciossherygon @hotmail.com, within a maximum period of 24 hours from access to the home or after the defect or damage occurs, with “Puesta de Sol Rentals Tenerife” not being responsible for any claim that has not been raised within this period.


10. LIABILITIES ATTRIBUTABLE TO “PUESTA DE SOL RENTALS TENERIFE”


If the reserved home presents serious deficiencies that prevent its normal use, “Puesta de Sol Rentals Tenerife” undertakes to find an alternative solution with similar characteristics and price. If this is not feasible due to a lack of available homes or because "The Client" rejects the proposals offered, part of the reservation amount will be refunded based on the time he has enjoyed the accommodation, without it being attributable to “Puesta de Sol Rentals Tenerife”. any additional responsibility.

“Puesta de Sol Rentals Tenerife” will not assume any responsibility in the following cases:

a) Negligence or omission of services attributable to third parties.

b) Failures or incorrect operation of swimming pools, children's play areas and sports facilities of any kind, the use of these being strictly under the responsibility of the user.

c) Infestation of insects in the holiday home or on its grounds.

d) Robberies or thefts in the home.

e) Damage to people or things caused by force majeure or unforeseen setbacks for which “Puesta de Sol Rentals Tenerife” nor its representatives can respond, such as wars, natural disasters or those related to pollution, drought, or others. unusual weather conditions, epidemics, border closures, traffic conditions, cessation of currency trading, technical failures, business closure or similar force majeure, which could not have been foreseen at the time of the conclusion of the rental agreement.

f) Temporary suspensions of local services, such as electricity, water, internet, TV, gas...

g) Possible inconvenience caused by the disturbance of neighbors of any kind and at any time. In the area where the vacation home is located, “The Client” may be exposed to noise from construction, traffic or similar. “Puesta de Sol Rentals Tenerife” is not responsible for any disturbances caused by noise.

h) Unavailability of any general service, television, swimming pools, accesses, wifi, elevators, etc.

i) Damage caused by misuse of household appliances: washing machine, dishwasher, boiler, coffee maker, heater, etc.

Consequently, the responsibility of “Puesta de Sol Rentals Tenerife” is limited to its intermediation function, in accordance with the scope that it has and is effectively carried out by it, not assuming any of the responsibilities that legally correspond to the property in the seasonal housing rental.

In any case, "The Client" accepts that the economic responsibility of “Puesta de Sol Rentals Tenerife” for any moral damages that may be caused as a result of its intermediation, will be limited to the total amount paid for the rental.


11. COMMUNICATIONS

All notifications between the parties will preferably be made via email. “The Client” is responsible for confirming receipt of the notifications and for informing “Puesta de Sol Rentals Tenerife” of any modification to their data, which is exonerated from any liability arising from this circumstance. In case of modification, “The Client” must inform “Puesta de Sol Rentals Tenerife” in writing via email from our website.

In compliance with article 21 of Law 34/2002 on Information Society Services and Electronic Commerce, we inform you that our commercial shipments and information related to our website and the products offered on it will be made by email to the e-mail address that you provide us, always revocable. 12. COMMITMENT, ACCEPTANCE AND VALIDITY OF THE CONTRACT

13. APPLICABLE REGULATIONS

This contract has a commercial nature, and will be governed and interpreted in accordance with Spanish laws.

In the event that any type of discrepancy or difference occurs between the parties in relation to the interpretation, content or execution of the Contract that is not resolved by mutual agreement, the Parties will submit to the courts or tribunals of the province of Santa Cruz. from Tenerife.



14. PERSONAL DATA

In accordance with the provisions of Organic Law 15/1999, "The Client" is informed that his personal data will be incorporated into the personal data file of “Puesta de Sol Rentals Tenerife”, and may exercise before it, in its offices. , the rights recognized in accordance with the L.O.P.D.



15. COOKIE POLICY
